Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the SafeSignal identity monitoring service, including the website at safesignal.ch and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

2. Who may use the Service

You may use SafeSignal if you:

• Are at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher).
• Have the legal capacity to enter into a binding contract.
• Are not prohibited from using the Service under applicable law.
• Are acting on your own behalf or with documented authorisation to act on behalf of an individual or organisation.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Provide accurate and complete information when creating your account.
• Keep your password secure and not share it with others.
• Notify us immediately at security@safesignal.ch if you suspect unauthorised access to your account.
• Not create more than one account per individual.

We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent purposes, or present a security risk to the Service.

4. Permitted use and monitored identifiers

SafeSignal is designed to help individuals monitor their own personal data. You may only add identifiers (email addresses, phone numbers, usernames) to your account that:

• Belong to you personally, or
• Belong to a family member or dependent who has given you explicit consent to monitor on their behalf, or
• Belong to your organisation and which you are authorised to manage.

You must not use SafeSignal to monitor identifiers belonging to other individuals without their knowledge and consent. Such use may constitute a violation of applicable privacy law, including the Swiss nDSG, EU GDPR, and US state privacy statutes.

5. Prohibited conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
• Use automated tools (bots, scrapers, crawlers) to interact with the Service without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell, sublicense, or transfer access to the Service to third parties without our written consent.
• Use the Service to harass, stalk, or spy on individuals.
• Introduce malware, viruses, or other malicious code to the Service.

6. Subscription, billing and cancellation

6.1 Free trial

We offer a 14-day free trial for new accounts. No credit card is required to start a trial. At the end of the trial period, the Service will be paused unless you subscribe to a paid plan.

6.2 Paid subscriptions

Paid subscriptions are available on a monthly or annual basis. Prices are listed in Swiss Francs (CHF) inclusive of any applicable taxes. By subscribing, you authorise us (via our payment processor) to charge your payment method on a recurring basis at the start of each billing period.

6.3 Price changes

We may change subscription prices. We will give you at least 30 days' notice of any price change by email. If you do not cancel before the new price takes effect, you will be charged the new price at your next billing date.

6.4 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period — you will continue to have access to the Service until that date. We do not offer partial-period refunds for monthly plans.

6.5 Annual plan refunds

If you cancel an annual plan within 14 days of your most recent annual charge, you are entitled to a pro-rated refund for the unused portion of the year. To request a refund, email billing@safesignal.ch.

6.6 Failed payments

If a payment fails, we will retry the charge and notify you by email. If payment cannot be collected within 7 days of the due date, your account may be suspended until payment is received.

7. Nature of the Service and limitations

SafeSignal is an identity monitoring and alerting service. It is important to understand what the Service does and does not do:

• The Service monitors known, publicly disclosed breach databases and dark web sources. It cannot detect breaches that have not yet been publicly disclosed or indexed.
• Receiving a "no breach found" result does not mean your data has never been compromised — it means your data was not found in the sources we monitor at that time.
• The Service provides alerts and information to help you take action, but it does not automatically change passwords, cancel accounts, or remediate breaches on your behalf.
• Breach monitoring coverage depends on the availability and accuracy of third-party data sources, including the HaveIBeenPwned API.

8. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure.
• All breaches affecting your data will be detected.
• The information provided is complete, accurate, or up to date.

9. Limitation of liability

To the maximum extent permitted by applicable law, SafeSignal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Intellectual property

The Service, including its design, code, text, graphics, and branding, is owned by or licensed to SafeSignal and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose.

You retain ownership of any data you provide to us (such as email addresses to monitor). By providing this data, you grant us a limited licence to process it for the sole purpose of delivering the Service.

11. Governing law and disputes

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. The courts of the Canton of Zurich, Switzerland shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.

If you are a consumer in the EU or EEA, you may also be entitled to bring a claim before the courts of your country of residence, and EU mandatory consumer protection laws may apply in addition to Swiss law.

Before initiating any formal dispute, we encourage you to contact us at contact@safesignal.ch to seek an informal resolution.

12. Termination

Either party may terminate this agreement at any time. You may terminate by cancelling your account. We may terminate or suspend your access to the Service if you violate these Terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the Service ceases immediately. Sections 7 (Disclaimer), 8 (Limitation of liability), 9 (Intellectual property), and 11 (Governing law) survive termination.
